These Terms of Service ("Terms") govern your access to and use of the Activity Savant website and our product, Actisav (together, the "Service"), provided by Activity Savant ("we", "us" or "our"). By accessing or using the Service, you agree to be bound by these Terms.
Use of the Service
You may use the Service only in compliance with these Terms and all applicable laws. You are responsible for any activity that occurs under your account and for keeping your account credentials secure.
Accounts
To use certain features you may need to create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account and for all activities under it.
Organizations and participant data
Organizations that use Actisav are responsible for the participant and program information they enter, including obtaining any necessary consents from participants or their guardians, and for using that information lawfully.
Payments and fees
Paid plans and transaction fees, where applicable, are billed as described at the time of purchase. Payments are processed securely through Stripe. Fees are stated in U.S. dollars unless otherwise noted. Except where required by law, payments are non-refundable once services have been provided.
Acceptable use
- Do not use the Service for any unlawful, harmful, or fraudulent purpose.
- Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
- Do not upload content that infringes the rights of others or violates applicable law.
Intellectual property
The Service, including Actisav and all related software, content and trademarks, is owned by Activity Savant and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, Activity Savant will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or profits, arising from your use of the Service.
Termination
We may suspend or terminate access to the Service if you violate these Terms or use the Service in a way that could cause harm. You may stop using the Service at any time.
Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
